Link to video...Huntsville attorney files suit against air duct cleaning & mold remediation company HUNTSVILLE, AL - Several months ago, a WHNT NEWS 19 Taking Action Investigation exposed the dirt on a company called Pure Kleen. It turns out the company was not so clean. The air duct cleaning business preyed on Valley consumers, convincing them they had mold. Pure Kleen may have bamboozled a lot of people, but they couldn't con the justice system. A Huntsville senior citizen hired Pure Kleen to clean her air ducts after seeing their full-page ad in the local newspaper. She didn't want us to reveal her identity. "Well, I thought that was a pretty good deal," she said. But then, air duct cleaning turned into something most of us are afraid of. The woman was told she had mold in her house even before the technicians stepped foot in the door. Suddenly, the ad for $79.95 turned into $5,000. "I fell for it and began to think after they left this doesn't sound right," she said. "I think it's a rip-off... they've been trained to say this. " You can't see his face or make out his identity, but he's been on the inside of the Pure Kleen operation. "We are trained to look for mold, find mold, and even if we don't find mold we're told to call in write up a huge estimate and call in for a discount," the man told us. "We use false mold test kits that always turn up purple, always turn up positive for mold." So we put Pure Kleen to the test, rigging a house with hidden cameras. And sure enough, we too were told we had mold in the house. However, testing by an independent laboratory revealed otherwise. WHNT NEWS 19 showed you the man behind the company, Ken Payer, and what happened when we tried to talk to him. He jumped in his car and sped off. Court documents show he's a businessman with a criminal record in a number of states. The man who used to be on the inside of Pure Kleen says, "They come into town they rape the town and then they leave." Before they left the Huntsville area, complaints started to mount at the Better Business Bureau of North Alabama, resulting in an "F" rating for Pure Kleen. In the midst of our investigation, Huntsville attorney Brent Jordan filed a civil lawsuit against Pure Kleen on behalf of a Decatur man. The lawsuit alleged the business had violated Alabama's Deceptive Trade Practice Act. "They came out quoted him a price of approximately $2,000, which was paid," said Jordan. "Turns out that they didn't do the work. Unfortunately, my client did not realize they didn't do the work until several months later when his house was put up for sale after a home inspection." Recently, the justice system sided with Jordan's client and awarded a $50,000 judgment by default. That's because Ken Payer never even bothered to show up in court to defend himself. It's a victory for Jordan and his client. "Evidence in the case showed that they engaged in fraud and this goes beyond negligence," said Jordan. "They flat out were defrauding people promising services that were never delivered, pocketing money and taking off." Ken Payer appears to have done just that. Jordan feels Payer "Should have been put away behind bars quite some time ago." And while Jordan's client may never see a penny of that money, it's still vindication. "My client wanted to pursue this because of the principal of the thing, but if it will help put a stop to this conduct in the future for other Alabamians, great," says Jordan. Ken Payer and Pure Kleen have picked up and moved on from the Huntsville area. There's no telling where they are now. Attorney Jordan may pursue other legal angles in this case with regards to Ken Payer. Meanwhile, the Better Business Bureau of North Alabama is working on a National BBB Alert on Pure Kleen. Ken Payer and company are known to change their business name and move from city to city. A BBB National Alert would connect the dots and could provide fair warning to consumers nationwide about Payer's practices before it's too late. Michele Mason, President of the BBB of North Alabama, says this is a classic example of why it's so important to check out a business with the Better Business Bureau before you hire one to do work for
